Law360, London (November 22, 2018, 1:34 PM GMT) -- Companies taking insurers to court over unpaid claims win only one in three cases, according to research published Thursday by a commercial insurance advisor.
Mactavish, which specializes in analyzing insurance governance and disputes, found that 32 percent of U.K. court cases or arbitration appeals against business insurers were won by policyholders between 2013 and 2018. This is despite 45 percent of large claims being disputed.
The advisory company said the win rate is low because terms of commercial policies are often unfavorable, which means policyholders cannot successfully challenge them if their insurer disputes a claim.
