ITV Urges Appeals Court To Overturn Pension Deficit Ruling

Law360, London (May 13, 2019, 6:44 PM BST) -- The Pensions Regulator does not have jurisdiction to issue enforcement actions stemming solely from activity that came before its establishment in 2005, a lawyer representing ITV told the Court of Appeal on Monday as he sought to overturn a ruling requiring the broadcaster to give financial support to a troubled pension scheme.

David Pannick QC, counsel for ITV, said the Upper Tribunal erred when it sided with The Pension Regulator, or TPR, in May 2018. The tribunal upheld the regulator's decision to make ITV support the 2,800-member pension scheme of Box Clever — a television rental business that collapsed in 2001...
