RSA Insurance Wins Appeal In Pool Repair Payout Dispute

Law360, London (May 13, 2019, 7:56 PM BST) -- Royal & Sun Alliance Insurance PLC does not have to pay out on a second indemnity claim from a pool company seeking to claw back repair costs, after an appellate court in London found a causal link between the firm's second notification and an earlier claim.

The Court of Appeal has allowed an appeal brought by RSA, which said a second claim for indemnity made by Euro Pools PLC in May 2008 should not be seen as a "new circumstance" but an extension of the problem that the pool company first filed a notification for in February 2007.
