Breaching Policy Warranties Can Partially Void UK Coverage

By Richard Mattick (March 27, 2018, 5:52 PM BST) -- On Dec. 18, 2017, Law360 reported that Aviva Insurance Ltd. and a unit of Ageas SA/NV had won their fight in the Commercial Court in London against a £1.75 million claim by a policyholder over a burnt down hotel. Judge Simon Bryan in the Commercial Court held (in BlueBon Ltd v Ageas (UK) Ltd [2017] EWHC 3301 (Comm)) that breach of a specific policy provision described as a warranty in the buildings insurance policy allowed Aviva and Ageas to deny coverage for the fire claim, although he refused to uphold the insurers' argument that the breach was grounds for making the policy completely void from inception....
