ORDER - Pending before the Court is Plaintiff Victoria Roehrman ("Roehrman")'s Motion for Leave to File a First Amended Complaint. Filing No. [34.] McAfee implicates futility as a basis for denying Roehrman's motion on its continued assertion that she has failed to prove personal jurisdiction in her complaint. McAfee has informed the Court that it plans to renew its challenge of personal jurisdiction at a later date. [Filing No. 39 at 2.] McAfee declines to oppose Roehrman's motion. The Court will not rule on this issue. Therefore, Roehrman's Motion for Leave to Amend is GRANTED. Also pending before the Court are McAfee's Motion for Judgment on the pleadings, [Filing No. 26], and Motion to Stay Discovery Until the Court Rules on McAfee's Pending Dispositive Jurisdictional Motion, [Filing No. 32]. The Court GRANTS Plaintiff's Motion for Leave to File an Amended Complaint, 34 . Within 7 days of this Order, Plaintiff is directed to file a First Amended Complaint. Further, Defendant's Motion for Judgment on the Pleadings, 26 , is hereby DENIED as moot. Defendant has 30 days from the date of Plaintiff's First Amended Complaint to file a new motion for judgment on the pleadings. During these 30 days, the Motion to Stay, 32 , will remain pending. At the end of the 30 days, the Court will either deny the motion as moot (if McAfee has not filed a new motion for judgment on the pleadings) or decide the motion on the merits (if McAfee has filed new a motion for judgment on the pleadings).
