Law360 Canada ( July 21, 2025, 1:25 PM EDT) -- Appeal by appellant the Queen Elizabeth Annex Parents’ Society (Society) against a decision dismissing its judicial review of a decision closing a school. The Queen Elizabeth Annex (QEA) was a small school operated by the Board of Education of School District No. 39 (Vancouver)(Board). It operated as a fully French Immersion school for kindergarten to grade three after which the students who wished to continue with French Immersion transferred to Jules Quesnel (JQ), a school located a kilometre away. The QEA was not a seismically safe school. Its age and deteriorating condition meant it was not worth repairing. The Board approved the permanent closure of the QEA and declared it as a surplus. The Board also leased the site to the francophone school board. The Society sought judicial review of the decision to close the school and declare it surplus. It argued that the closure was procedurally unfair, unreasonable, and made in bad faith, and contested the cost order imposed against them. However, the judicial review was dismissed, with costs ordered against the Society, prompting it to appeal the decision....
