Law360 Canada ( August 14, 2025, 12:47 PM EDT) -- Appeal by Duhamel from chambers judge’s decision dismissing his petition for judicial review. Duhamel sought judicial review of a decision by the Independent Investigations Office of British Columbia (the “IIO”), to publish a document on its website summarizing the results of an investigation into the conduct of a police officer (the Decision). Duhamel was an interested member of the public. He filed a petition for judicial review, claiming the IIO’s decision to publish the document was unreasonable in the sense that the summary contained information that was not authorized by the legislation. The chambers judge dismissed Duhamel’s petition on the basis that he did not have standing and ordered him to pay costs at Scale B. Duhamel argued that the judge erred in denying him standing and ordering him to pay costs at Scale B. He maintained that he was directly affected by the Decision, and it was procedurally unfair for the chambers judge to order costs at Scale B in the absence of submissions on the correct scale.
