    3rd Circ. Will Reconsider Shipbuilder's Ch. 11 Reopening Bid

    The Third Circuit said Thursday that it will reconsider whether to reopen Congoleum Corp.'s 2003 Chapter 11 bankruptcy so the bankruptcy court, not a district court, can say whether Congoleum affiliate Bath Iron Works should share liability for cleaning up a polluted New Jersey river.

    Profs Urge 3rd Circ. To Rethink Reopening Shipbuilder Ch. 11

    A group of law professors have asked the Third Circuit to grant shipbuilder Bath Iron Works' request for a rehearing on its bid to reopen the Chapter 11 case of its former affiliate in order to allocate responsibility for a number of environmental remediation costs, saying it is of "central importance" a bankruptcy court and not a civil court adjudicate the issue.

    The Third Circuit ruled Thursday that Bath Iron Works' potential liability over a polluted New Jersey river doesn't affect the Chapter 11 case of the shipbuilder's former affiliate, backing a district court that decided a bankruptcy judge erred in reopening the case.

    Shipbuilder Urges 3rd Circ. To Back Bankruptcy Court Ruling

    Shipbuilder Bath Iron Works Corp. on Wednesday told a Third Circuit panel that a bankruptcy judge is the proper person to decide whether an insurance settlement in the 2003 bankruptcy of a former corporate affiliate protects Bath Iron Works from liability for the cleanup of a polluted New Jersey river.
