A California tribe that says an Oregon-based electric utility is operating hydroelectric dams under an expired license urged the D.C. Circuit on Friday to order the Federal Energy Regulatory Commission to proceed with the relicensing process after years of alleged delays.

PacifiCorp, an Oregon-based electric utility, and conservation groups denied a tribe's allegations that the utility is operating hydroelectric dams under the terms of an expired license, telling the D.C. Circuit court Wednesday that PacifiCorp is actually making environmental improvements under a settlement agreement.

The state of Oregon and a California water agency urged the D.C. Circuit Tuesday to deny a tribe's bid to bring an electric utility's license for a hydroelectric project in line with current environmental standards, saying the federal government properly concluded the states retain authority to certify water quality under the license.
