The Sierra Club will be allowed to refile a suit against the Federal Energy Regulatory Commission aiming to stall construction on the $2.2 billion Nexus pipeline after the nonprofit had to pull its initial petition, the D.C. Circuit said Wednesday.

The Federal Energy Regulatory Commission and developers of the $2.2 billion Nexus pipeline on Tuesday told the D.C. Circuit that the Sierra Club shouldn't get another chance at blocking the project's construction after discovering that a landowner who sided with the group in the suit had sold his property to the developers without the group's knowledge.

The Sierra Club asked the D.C. Circuit on Monday to pause the $2.2 billion Nexus gas pipeline while the Federal Energy Regulatory Commission considers its challenge to the project, saying the commission hasn't proven a public benefit and that allowing it would cause its members irreparable environmental harm.
