Los Angeles Angels owner Arte Moreno testified Monday that he became "very concerned" about noise from a fire suppression system, as a Manhattan federal judge weighed his claim for the return of an $8.5 million deposit he made in a Park Avenue penthouse deal that never closed.

The company behind a 35-unit luxury condominium project in New York City is suing Los Angeles Angels owner Arturo R. Moreno for more than $10 million for breach of contract after he didn't close on the purchase of a $34 million condo unit, saying he used the unit's proximity to the building's automatic fire pump system as an excuse to back out of the transaction.
