A New Jersey federal judge on Friday dismissed Merck & Co. Inc.'s claim that Canadian generic drug maker Apotex Inc. infringes a patent covering Nasonex nasal spray, but also rejected Apotex's claims that the patent was invalid.

A New Jersey federal judge on Wednesday refused to grant Apotex Inc. a ruling that it does not infringe one of three patents covering Nasonex nasal spray in a suit lodged by Schering Corp. to block a generic version of the treatment.
