An Eleventh Circuit panel used the wrong bad faith standard in overturning a lower court finding that Atlantic Specialty Insurance Co. did not deny a yacht owner's claim in bad faith, the insurer has contended, asking the panel to reconsider its decision.

The Eleventh Circuit on Monday ruled that a lower court had erred by deciding too quickly that an insurance company didn't act in bad faith by denying a yacht owner's claim after the boat caught fire, finding that a triable issue of facts exists.
