MEMORANDUM ORDER (Dismissing Claims) - The Court hereby GRANTS Officer Frazer and Detective Jecklin's Motion (ECF No. 11 ) as well as the City's Motion (ECF No. 8 ) and DISMISSES WITHOUT PREJUDICE Plaintiff's Complaint. Plaintiff shall have leave to amend his Complaint within twenty-one (21) days of the date of this Order. The Court DIRECTS the Clerk to close the case. If Plaintiff files an Amended Complaint within twenty-one (21) days, the Clerk SHALL reopen the case. Should Plaintiff wish to appeal this Order, he must file a written notice of appeal with the Clerk of Court within thirty (30) days of the date of entry.
