Chief District Judge Denise J. Casper: ELECTRONIC ORDER entered re D. 2 . The Court has considered Plaintiff’s motion for leave to file the proposed action as required by the Order of Enjoinment entered in Kifor v. Commonwealth of Mass., 25-11831-AK, D. 31 (entered March 31, 2026). If allowed, this case would mark the eighth, federal case that Plaintiff has filed regarding his dissatisfaction with state court proceedings. Id., D. 26 (entered March 25, 2026) at 4 (listing cases). As in the case dismissed by other session of this Court earlier this year, id., Plaintiff again is seeking to sue the Commonwealth of Massachusetts and, again, has not sufficiently explained why that party is suable in this case. To the extent he didn’t name the other defendants, the Supreme Judicial Court and the Chief Justice of that court, in that prior case, his filings here do not explain how his claims arising out of their alleged conduct done in the exercise of judicial functions are not, at a minimum, barred by judicial immunity. See Cline v. Burke, 682 F. Supp. 3d 125, 131 (D. Mass. 2023) and cases cited. For at least these reasons, the Court DENIES Plaintiff’s motion to open this action. (CAM)
