ORDER: For the reasons stated below, Plaintiff's Rule 15 Motion for Leave to File Supplemental Pleading (Doc. No. 44 ) will be DENIED, and Plaintiff's Motion for Miscellaneous Relief and Clarification from the Court Concerning Issues Related to Dispositive Motion Papers (Doc. No. 38 ) will be GRANTED. Under the circumstances and because of the Court's preference for resolving claims on the merits, the Court will accept Plaintiff's late-filed response to Defendant's statement of undisputed material facts and Statement of Additional Material Facts.
