Order on Motion to Dismiss Order on Motion for Summary Judgment
ORDER Granting Motions to Dismiss and Denying Motions for Summary Judgment. Defendant DOL's motion to dismiss (Doc. 16 ) is GRANTED because the court lacks subject matter jurisdiction and thus Plaintiff's claims against it are DISMISSED without prejudice. Defendant Marble Valley's motion to dismiss (Doc. 19 ) is GRANTED because Plaintiff cannot state a claim under the ADA for disability discrimination based on his use of medical marijuana. The Complaint is DISMISSED and, as a result, Plaintiff's motions for summary judgment (Docs. 24 , 25 ) are DENIED AS MOOT. Signed by Chief Judge Geoffrey W. Crawford on 2/14/2024. (sjl)
