The Court denies Plaintiff's 92 Motion for Miscellaneous Relief Requesting Reconsideration of Dismissal, and, if Denied, Transmittal of the Relevant Court Record to the Ninth Circuit. The request for reconsideration is denied because Plaintiff has not shown "manifest error" in the Court's 90 Order Granting Motion to Dismiss or "new facts or legal authority which could not have been brought to its attention earlier with reasonable diligence." LCR 7(h)(1). The Court denies as unnecessary Plaintiff's request that the Court "direct that the relevant court records be transmitted or made accessible to the United States Court of Appeals for the Ninth Circuit so the appellate court has the full record before it on appeal" because the appellate court has access to this Court's docket, and if Plaintiff does not file excerpts of record, "counsel for appellee or respondent must file Supplemental Excerpts of Record that contain all of the documents that are cited in the pro se opening brief or otherwise required by Rule 30-1.4, as well as the documents that are cited in the answering brief."
