Order on Motion for Attorney Fees

Plaintiff moves for attorney fees and costs as a prevailing party. Dkt 106 . It asks for $934,357.75, but it did not comply with court's procedures on fee petitions, which require parties to support their request with billing logs and other evidence showing that the time spent and the rates charged are reasonable. Attachment to Dkt. 8 , at 39. In their response to the motion, defendants say that they do not dispute that plaintiff is a prevailing party and is entitled to reasonable fees, but they cannot take a position on what reasonable fees are without more information. They ask for the opportunity to resolve that issue with plaintiff informally, and they represent that plaintiff has agreed to that proposal. Dkt. 108 . As a result, plaintiff's motion, Dkt. 106 , is GRANTED in part and DENIED without prejudice in part. The court finds that plaintiff is a prevailing party. But the court cannot determine without more information whether plaintiff's fees are reasonable. Plaintiff may have until June 3 to either: (1) inform the court that the parties have agreed to an amount of fees; or (2) submit a renewed motion on the amount of fees and costs that complies with the court's procedures. If the parties do not settle the dispute, the court expects plaintiff to explain persuasively why it is entitled to nearly $1 million in fees in a case that involved a limited set of facts, did not proceed to trial, and resulted in only partial success for plaintiff.
