Bank Can't Use Witness Statements In €1.9M Guarantee Row

Law360, London (April 12, 2019, 6:30 PM BST) -- A London judge on Friday struck out three witness statements served by Crown Financial and Merchant Bank PLC in its fight against a €1.9 million ($2.1 million) suit brought by an engineering and construction firm, ruling that they were not relevant to the issues at the heart of the dispute.

Judge Christopher Butcher said that the scope of the witness statements were in support of an “unpleaded” and “untenable” allegation from Crown Financial, a bank incorporated in England, that SBR Soletanche Bachy Fundatii SRL committed fraud by sending out invoices for construction works that were never carried out.
