ORDER: On August 19, 2026, the Court presided over a hearing with the parties. For the reasons stated on the record, it is hereby ORDERED that: (1) Plaintiff is granted leave to file an amended complaint within fourteen (14) days from the date of this Order; (2) Defendant's Motion to Dismiss (Doc. # 23 ) is DENIED AS MOOT and WITHOUT PREJUDICE; (3) Plaintiff's request for a preliminary injunction is GRANTED IN PART. The request is GRANTED insofar as Defendant is preliminarily enjoined from using Plaintiff's trademarks as requested in the Petition (Doc. # 1 , p. 11, (a), (b), (c)). The request is otherwise DENIED; (4) a Magistrate Judge will be appointed to preside over a mediation; and (5) financial records shall be disclosed pursuant to Fed. R. Civ. P. 26(a)(1)(A)(iii).
