Status Conference Order on Motion for Extension of Time to File
Minute Entry for Telephonic Status Conference proceedings held on 8/20/2026 before Magistrate Judge James R. Cho. Joseph Perl appeared for plaintiff. Arthur G. Jakoby and Michael Ryan Feeney appeared for defendants Alex Maiorescu and Kerry Sullivan, and Timothy William Salter appeared for defendant JP Morgan Chase Bank (collectively, "defendants"). Defendants Noya 23, LLC and Oluwole Adebowale ("Adebowale") did not participate in the conference.
Case discussed. Parties do not believe settlement discussions would be productive at this time. For the reasons stated on the record, the Court grants plaintiff's Motion for Service by Publication 22 , including the 120-day extension of time to serve Adebowale. The Court further grants the parties' Motion to Stay Discovery Pending Motions to Dismiss 29 . The Court denies as moot defendants' motion 30 for an extension of time to submit a proposed scheduling order.
The Court adopts the parties' proposed motion to dismiss briefing schedule. The parties are reminded that District Judge Morrison's individual rules include a bundling practice. See Individual Rule 5.2.3.1. By 9/25/2026, defendants shall serve, but not file, their motions to dismiss the complaint. By 10/26/2026, plaintiff shall serve, but not file, its opposition. By 11/23/2026, defendants shall serve their reply briefs, if any. On the day the motion is fully briefed, each party shall electronically file its own moving papers, and the movant shall submit a letter specifying each document that has been filed by either party.
