Mediation Referral Order
ORDER: This Court, having considered the parties' stipulation set forth above, orders that: 1. The Parties shall enter mediation prior to formal filing of this matter with the AAA; and 2. In the event of an unsuccessful meditation, Plaintiff shall, within 60 days of the mediation, submit all claims as asserted in the Action to binding arbitration before the AAA in accordance with its Arbitration Rules and Procedures; and 3. The Action is stayed pending the outcome of the arbitration, provided, however, that this Court will retain jurisdiction over this matter until, at a minimum, 30 days after either Party notifies the Court of the conclusion of arbitration. 4. Beginning on Monday, November 2, 2026, and every three months thereafter, on the first business day of each month, the parties must submit a status report via ECF, not to exceed two (2) pages, informing the Court of the status of the AAA arbitration and stating whether this matter should remain stayed.
