SCHEDULING ORDER - The Court has reviewed the parties' post-trial briefing (ECF 195 , 196 ) and related filings (ECF 197 , 198 ) and agrees that oral argument is unnecessary. The Court, however, requests supplemental briefing addressing only NAW's argument that the RMA's "small producer" exemption for Oregon public bodies, ORS 459A.863(32)(b) and ORS 459A.872(1), is facially discriminatory, in violation of the Dormant Commerce Clause. Defendant Feldon is REQUESTED to file such a brief, not to exceed five pages, by Friday, August 7 at 5:00 p.m., and Plaintiff NAW may file a response, not to exceed five pages, by Monday, August 10 at 5:00 p.m. Ordered by Judge Michael H.
