MINUTE ORDER denying the plaintiff's 47 Motion to Alter or Amend the August 11, 2026 Order, to Reopen the Case, and to Accept the Second Amended Complaint. Rule 59(e) permits the Court to grant a motion to reconsider when "there is an intervening change of controlling law," there is "new evidence" available, or there is a "need to correct a clear error or prevent manifest injustice." Firestone v. Firestone, 76 F.3d 1205, 1208 (D.C. Cir. 1996) (per curiam) (citation modified). Rule 60(b)(1), in turn, permits the Court to "relieve a party...from a final judgment, order, or proceeding for...mistake, inadvertence, surprise, or excusable neglect." Fed. R. Civ. P. 60(b)(1). Granting a motion pursuant to either rule is an "unusual measure...requiring a demonstration of extraordinary circumstances by the moving party." Black v. Tomlinson, 235 F.R.D. 532, 533 (D.D.C. 2006) (citation modified).The plaintiff has not demonstrated entitlement to relief under either rule. The Court directed the Clerk of Court to close this case on August 11, 2026, after the plaintiff missed the August 7, 2026 deadline the Court had set for the filing of her second amended complaint. See August 11, 2026 Minute Order. While the plaintiff notes that she filed on or around August 7, 2026, two motions for extensions of that deadline, the Court had previously warned the plaintiff that it would not grant any further extensions and that, should she fail to file her second amended complaint on or before August 7, 2026, the Court would direct the Clerk of Court to close this case. See July 20, 2026 Minute Order. In light of those warnings, the plaintiff has not identified any grounds warranting relief pursuant to Rule 59(e) or Rule 60(b)(1) here. So Ordered by Judge Dabney L.
