ORDER re 85 : The parties report that they have reached a settlement in principle. By 10/31/2026, Plaintiff shall file the motion for preliminary approval of the class settlement, which agreement will be evaluated for compliance with the requirements for preliminary approval of class action settlements under Fed. R. Civ. P. 23(e) and Moses v. N.Y. Times Co., 79 F.4th 235 (2d Cir. 2023). The motion shall include, at minimum: (1) a copy of the proposed settlement agreement; (2) a brief that includes a fulsome analysis of the factors set forth in Moses, 79 F. 4th at 242-46 and City of Detroit v. Grinnell Corp., 495 F.2d 448, 462-63 (2d Cir. 1974) (Fed. R. Civ. P. 23(e)); and (3) any proposed notice(s), claim form(s), and preliminary approval order(s). The parties may include other relevant information to assist the Court's review of the settlement, including but not limited to sworn declarations or other evidence.
