ORDER. Ciena's motion to dismiss for failure to state a claim [ECF 41 ] is GRANTED. Ciena's motion to dismiss for lack of subject matter eligibility [ECF 42 ] is DENIED AS MOOT. K.Mizra will be granted leave to file a second amended complaint that complies with this Order, but not before the USPTO resolves its related proceedings. Accordingly, Ciena's motion to stay [ECF 64 ] is GRANTED. The parties are DIRECTED to file a joint Notice with the Court within 7 days of a decision by the USPTO on the related proceedings. In light of the stay, the Clerk is DIRECTED to administratively close this case.
