ORDER granting Defendant CoinMarketCap OpCo., LLC's ("CMC") 118 Motion to Dismiss. CMC is dismissed from the case with prejudice. IT IS FURTHER ORDERED granting Defendant BAM Trading Services Inc's ("BAM") Motion to Dismiss (Doc. 119 ) as to Counts 3 and 4 only. Counts 3 and 4 are dismissed with prejudice. IT IS FURTHER ORDERED granting Defendant BAM's Motion to Compel Arbitration (Doc. 119 ) as to all remaining Counts asserted against BAM. The case is stayed until arbitration is terminated. The parties are ordered to file a joint status report every 120 days until the arbitration is terminated. If the parties prefer to avoid this obligation, they may stipulate to dismiss this action without prejudice and that the defendant waives any statute of limitations defense based on the period the dispute is with the arbitrator.
