MINUTE entry before the Honorable Steven C. Seeger: On August 24, 2026, Plaintiffs Rockwell Properties and Westfield Insurance Company filed a motion to dismiss all claims asserted by them in this case. (Dckt. No. 156 ) This Court responded by granting the motion and closing the case. As it turns out, this Court jumped the gun. The motion was filed by Rockwell and Westfield (only). The other two Plaintiffs, Prairie Management & Development and Scottsdale Insurance Company, did not join that motion. Their claims remain pending, so the case shouldn't have been closed. This Court regrets any confusion created by the display of judicial trigger-happiness. This Court's order dated August 27, 2026, is hereby vacated to the extent that it purported to cover the case as a whole. The claims brought by Rockwell Properties and Westfield Insurance Company are dismissed. The claims brought by Prairie Management & Development and Scottsdale Insurance Company are not dismissed. The Court directs the Clerk's Office to reinstate the case. The case is returned to the status quo ante as to the two remaining Plaintiffs, including the prior referrals to the presiding Magistrate Judge. Remaining parties are to update the court (settlement_statement_kim@ilnd.uscourts.gov) again by September 14, 2026, on whether they executed the necessary documents unless a stipulation to dismiss the case is filed with the presiding District Judge before then.
