MINUTE entry before the Honorable Young B. Kim: A hearing on Plaintiffs' motion for sanctions 133 is scheduled for July 1, 2026, at 1:00 p.m. in courtroom 1019. Parties should plan on being in court for at least one hour for the hearing. If this hearing date and time poses a conflict, the parties are to jointly contact Courtroom Deputy Erin Caswick (erin_caswick@ilnd.uscourts.gov) to find an alternate date and/or time that works. In the motion, Plaintiffs argue that Defendant failed to produce documents responsive to their Second Requests for Production of Documents ("S-RFP") Nos. 7-10 in accordance with this court's order. (R. 133.) On February 24, 2025, this court ordered Defendant to produce "sufficient documents reflecting how Plaintiffs' claims under the AI Endorsement should have been processed" in response to S-RFP Nos. 7-10. Defendant opposes the motion and argues that: (1) Plaintiffs' motion is untimely because it was due on May 21, 2025, (R. 116), but they did not until October 29, 2025; and (2) it has complied with this court's order when it produced documents Bates-numbered 2516 through 2710 ("2516 Documents"). This court has questions for the parties on various issues, including whether: (1) the motion for sanctions is untimely; (2) communications are necessarily responsive to S-RFP Nos. 7-10; (3) limiting the search for claims "coded" as involving the subject endorsement was reasonable; and (4) 2516 Documents include documents "reflecting how Plaintiffs' claims under the AI Endorsement should have been processed." This court requires Kristen Dickinson to be available by phone for the hearing in case this court has questions for her. Parties are to be prepared to address these issues at the motion hearing and to discuss the status of fact discovery, fact and expert discovery they still need, and a schedule for completing all discovery.
