TEXT ORDER: Before the Court is the parties' Consent Motion to Prospectively Amend the Amended Order for Preliminary Injunction. See d/e 876 . Federal Rule of Civil Procedure 60(b)(5) authorizes the Court to modify an injunctive order when "applying it prospectively is no longer equitable." The parties have agreed that Section III of the Court's Amended Order, see d/e 822 , which imposes on Dish certain semi-annual disclosure obligations, is "no longer equitable" in its present form. The parties seek to amend Section III to require that Dish produce its internal telemarketing compliance materials "upon request." For good cause shown, the parties' motion, d/e 876 , is GRANTED. The Court shall enter a Second Amended Order in accordance with the parties' request. Entered by Judge Sue E Myerscough on 3/16/2023. (JPS)
