NOTATION ORDER: the parties Joint Motion to Approve Settlement Agreement 15 is DENIED to the extent that it seeks the Courts review or approval of the settlement agreement between the parties. The Court is neither required nor permitted to approve settlement agreements under the FLSA, Gilstrap v. Sushinati LLC, 734 F. Supp. 3d 710 (S.D. Ohio 2024), nor as to any of the other claims set forth in the Complaint in this action. That said, the Court will treat the motion as an unopposed motion to dismiss the action with prejudice, with the Court to retain jurisdiction over the parties' settlement agreement. See Kokkonen v. Guardian Life Ins. Co. of America, 511 U.S 375 (1994). Thus understood, the Court GRANTS the motion and directs the Clerk to enter judgment DISMISSING this case WITH PREJUDICE, but with the Court to RETAIN JURISDICTION over the settlement agreement.
