MINUTE entry before the Honorable Andrea R. Wood: Plaintiff's objection to the magistrate judge's order dated 2/10/2026 (Dkt. No. 266) is granted in part, but only insofar as the Court remands the issue to the magistrate judge for clarification and/or reconsideration. Specifically, Plaintiff has objected to the magistrate judge's denial of her request to issue a subpoena to the United States Central Command ("CENTCOM"). She claims that the denial constituted clear error because the CENTCOM records are directly relevant to the cause and circumstances of her husband's death. As Plaintiff explains, "[g]iven the conflicting official death certificates, the requested materials are indispensable to establishing the factual basis of Plaintiff's claim for insurance benefits." (Id. at 2.) The magistrate judge denied the request to issue a subpoena to CENTCOM with little fanfare in a minute order. Notably, the magistrate judge denied the request without prejudice, stating that Plaintiff had failed to show how the cause of her husband's death is relevant to her claim for insurance benefits. This leads the Court to the following observations. In denying Plaintiff's motion without prejudice, the magistrate judge appears to indicate that he would entertain a renewed request that provided a more fulsome explanation of the relevance of the requested material. Indeed, Plaintiff's motion for leave to issue the subpoena does not reference any specific claims that survived Defendants' motion to dismiss or this Court's rulings explaining why those claims survived that might provide a basis for her requested subpoena. For example, the Court acknowledges that in denying National Union's motion for judgment on the pleadings, it found that "there is clearly a factual dispute over the cause of [Plaintiff's husband's] death," and that the insurer was incorrect in arguing that "the potentially accidental nature of [Plaintiff's husband's] death is immaterial." (Dkt. No. 211 at 10.) The Court does not mean to suggest that it believes its findings warrant allowing the requested discovery but rather points them out to illustrate that there is simply not enough in the magistrate judge's order to determine whether those matters were considered. For that reason, the Court finds it prudent to return this issue to the magistrate judge for clarification regarding the basis for his ruling or, alternatively, to allow Plaintiff an opportunity to renew her motion to add the information that the magistrate judge found lacking the first time. If Plaintiff renews her motion and the magistrate judge denies the request, Plaintiff will have 14 days from that order to file an objection pursuant to Fed. R. Civ. P. 72(a).
