MINUTE ORDER: In light of the 36 Notice of Voluntary Dismissal, the Court dismisses this case. The Court dismisses the claims against the Defendants Santander Consumer USA Inc., Ally Financial, Inc., and Exeter Finance Corp. without prejudice. But the Court dismisses the claims against the Defendants Openroad Lending, LLC, and Range View Management LLC with prejudice. The Plaintiff has brought and voluntarily dismissed these claims against these Defendants in another district. See Alston v. Carmax Business Services, LLC, No. 8:25-cv-00214, ECF No. 4 (D. Md. January 23, 2025) (raising the same claims arising from the Plaintiff's 2024 credit reports); id. ECF Nos. 41, 42 (D. Md. May 8, 2025). Accordingly, the Court finds that dismissal with prejudice is appropriate. See Fed. R. Civ. P. 41(a)(1)(B) ("[I]f the plaintiff previously dismissed any federal- or state-court action based on or including the same claim, a notice of dismissal operates as an adjudication on the merits."). Finally, the Court dismisses the claims against the Defendant Better Mortgage Corporation with prejudice in light of the 31 Stipulation of Dismissal.
In light of the Plaintiff's troubling litigation history, the Court is concerned about the Plaintiff's suggestion that his dismissal of this action may be motivated by forum shopping. See 36 Notice ("Considering the Court's 02/10/26 MINUTE ORDER stating it was considering converting Defendants' Motions to Dismiss to Motions for Summary Judgment . . . the Plaintiff has concerns about the manner in which the case is presently being managed. In light of those concerns, and in the interest of pursuing his claims in a forum where he can be assured of a more equitable proceeding, the Plaintiff elects to voluntarily dismiss this action."). Although the Plaintiff's conduct in another venue is beyond the control of this Court, the Court reminds the Parties that the Federal Rules of Civil Procedure provide some protections against forum shopping. See Fed. R. Civ. P. 41(d). The Court directs the Clerk of the Court to terminate this case from the active docket. Signed by Judge Sparkle L. Sooknanan on 2/26/2026. (lcak)
