TEXT MINUTE ENTRY -- This matter was set for a Pretrial Conference on June 23, 2026 at 10:00 a.m. before Magistrate Judge Ryan C. Carson. Jason Grams, Michael Knoerzer, and Kevin O'Connor appeared for Plaintiff. Scott Davis, Tyler Scott, and Joshua Dickinson appeared for Defendant TIG. The conference was set to address pretrial matters, but the parties instead discussed issues related to case progression and the amount of trial time needed. The trial is currently scheduled for five (5) days. The parties do not believe that will be sufficient to try all the issues in the case, and the court agrees. Accordingly, on the court's own motion, the trial date of August 3, 2026, is hereby vacated. The matter will be reset for ten (10) trial days. The court will send options via email for the rescheduled trial. The parties shall then confer and select a new trial date. Based upon the new trial date, the court will set a new pretrial conference date and updated deadlines for supplemental trial briefs and deposition designations. The parties are also directed to confer on whether the matter should be tried to a jury or to the bench.The court also raised whether Filing No. 345 (Plaintiff's Motion to Exclude) can be withdrawn, since those witnesses were not designated for trial and Horace Mann is no longer a party. Plaintiff agreed to look into the issue and, if appropriate, file a motion to withdraw on the docket.The court encouraged the parties to continue settlement discussions and to advise whether a court-supervised settlement conference would be beneficial.
