Order ~Util - Terminate Deadlines
MINUTE ENTRY AND ORDER re: The Court has reviewed the joint discovery and case management plan and the previously entered scheduling and docket control order. Dkts 9 & 5. The Court believes that deadlines previously entered under the current SDCO are appropriate to this matter notwithstanding enlargement of those deadlines as now requested by the parties. The parties must abide by current deadlines of request assignment of their case to the Magistrate Judge, who will accommodate a lengthier schedule. The initial conference set for September 1, 2023, is CANCELED pursuant to Section 9(e) of this Court's procedures. Any party may request reinstatement of the status conference by email to the Case Manager with explanation why the conference remains necessary. It is ORDERED that (i) no continuance will be granted absent a showing of actual diligence and extraordinary cause, and (ii) discovery failures may result in the striking of evidence, dismissal of claims, or the striking of defenses.
