Minute Order Order on Discovery Plan and Scheduling Order
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 10/14/2026. SCHEDULING ORDER Denying 18 Discovery Plan and Scheduling Order;
Re: 18 Third Stipulated Discovery Plan and Scheduling Order.
The parties have filed a third stipulation amending the discovery plan and scheduling order. (ECF No. 18 ). The Court reminds the parties of its previous Minute Order (ECF No. 17) denying the parties' second stipulation amending the discovery plan and scheduling order because it did not comply with LR 26-3. The parties' current stipulation (ECF No. 18 ) still does not comply with LR 26-3.
Under LR 26-3(a)-(d) the stipulation must include: "(a) A statement specifying the discovery completed; (b) A specific description of the discovery that remains to be completed; (c) The reasons why the deadline was not satisfied or the remaining discovery was not completed within the time limits set by the discovery plan; and (d) A proposed schedule for completing all remaining discovery." The parties provide a proposed schedule to complete remaining discovery, but they do not include a statement specifying the discovery that has been completed thus far or a specific description of the discovery that remains to be completed. Thus, the Court DENIES the parties' stipulation (ECF No. 18 ). Going forward, the parties' filings must comply with the Local Rules.
IT IS SO ORDERED.
