CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER: All Parties do not consent to conducting all further proceedings before a Magistrate Judge, including motions and trial. 28 U.S.C. § 636(c). Plaintiffs request this case be tried to a jury. Following the Court's decision on the motion to dismiss docketed at MDL ECF No. 1249, Google LLC and Alphabet Inc. (together, "Google") shall either (a) within 10 days of the Court's decision, submit a pre-motion letter seeking leave to file a motion to dismiss the complaint, or (b) within 21 days of the Court's decision, answer the complaint. Amended pleadings may not be filed and additional parties may not be joined except with leave of the Court. Any motion to amend or to join additional parties shall be filed within 30 days from the date of this Order. Fact discovery shall commence upon entry of this Order only as permitted under the terms of this Order. Initial disclosures pursuant to Fed. R. Civ. P. 26(a)(l) shall be served by August 7, 2026. Parties have an ongoing duty to supplement initial disclosures pursuant to Fed. R. Civ. P. 26(e). As further set forth herein. All other fact discovery is stayed pending further Order of this Court. Plaintiffs may serve up to 15 Requests for Production on Google. Google may serve up to 25 Request for Production on Plaintiffs. Expert discovery is stayed pending further Order of this Court. Within 21 days of either Google's Answer in Plaintiffs' case or the Court's ruling on any motion to dismiss filed by Google against Plaintiffs' complaint, the Parties shall meet and confer regarding a case management and scheduling order setting a schedule for fact and expert discovery. 9. The Stipulation and Order Regarding Expert Discovery (ECF No. 428), the Order Regarding Discovery Procedure (ECF No. 508), the Modified Confidentiality Order (ECF No. 685), and the Further Modification thereto (ECF No. 1860), shall apply in this case. The time for filing Final Pre-Trial Submissions is stayed pending further Order of this Court. The next Case Management Conference will be scheduled at a future date. This Scheduling Order is entered pursuant to Fed. R. Civ. P. 16(b), and may not be modified or the dates herein extended, except by further Order of this Court for good cause shown. Any application to modify or extend the dates herein shall be made in a written application in accordance with the Court's Individual Practices and shall be made no less than 14 days prior to the expiration of the date sought to be extended. ORDER denying 1900 Letter Motion for Discovery. The principle enunciated by Plaintiffs counsel, take to its extreme, would lead to an inability to address cases in the order in which they were filed.
