ORDER ON MOTIONS FOR SUMMARY JUDGMENT: Briggs' motion for summary judgment (Doc. 52 ) is GRANTED in part, and the negligence claim in Count IV is DISMISSED insofar as it is based on a failure to inspect the forklift. The motion is DENIED in all other respects. Hyster-Yale's motion for summary judgment (Doc. 57 ) is GRANTED in part, and the breach of warranty claim in Count III of the complaint is DISMISSED. The motion is DENIED in all other respects. Any claims against the fictitious defendants (John/Jane Does 1-20 and ABC Corporations 1-20) are DISMISSED, and the Clerk shall terminate those parties in CM/ECF. Within 7 days from the date of this Order, the parties shall confer and file a notice identifying several mutually agreeable dates and times over the following two weeks for a telephonic case management conference to schedule what remains of this case for trial.
