TEXT ORDER entered by Judge Sara Darrow on September 2, 2026. Plaintiff's 12 motion for reconsideration of the Court's August 19, 2026 Text Order and motion for leave to amend complaint to add Galesburg Hotel, LLC as a Defendant is DENIED IN PART and GRANTED IN PART. The Court DENIES the request to reconsider its August 19, 2026 Text Order dismissing Holiday Inn Express & Suites Galesburg as a Defendant in this case. The Court recognizes that Plaintiff states she did not receive the Court's July 30, 2026 Text Order directing her to provide service information for Holiday Inn Express & Suites Galesburg, Illinois. However, Plaintiff's 12 motion makes clear that Holiday Inn Express & Suites Galesburg is not an entity capable of being sued in its own name and is rather simply the name of the building where Plaintiff worked. That Holiday Inn Express & Suites Galesburg is not a defendant in this suit does not mean Plaintiff cannot refer to it or describe actions as occurring there. Plaintiff's request to amend her complaint to add Galesburg Hotel, LLC as a Defendant is GRANTED. Plaintiff may file her amended complaint adding Galesburg Hotel, LLC as a Defendant by September 23, 2026. Plaintiff's 16 Motion Requesting Court-Directed Service of Process Pursuant to Federal Rule of Civil Procedure 4(c)(3) is DENIED. The Court clarifies that it has already obtained a 11 waiver of service from Defendant Janko Hospitality LLC. The Court will not request a waiver of service from Galesburg Hotel, LLC until Plaintiff files an amended complaint naming Galesburg Hotel, LLC as a defendant. Janko Hospitality LLC's answer is currently due September 8, 2026. The Court vacates the answer deadline and will reset it after Plaintiff files her amended complaint. (BL)
