Scheduling Order
ORDER. As discussed during the conference, the parties must serve initial disclosures on or before 10/9/2026. The parties must serve initial document requests and interrogatories on or before 10/22/2026. The deadline for filing an amending pleading, adding additional parties or commencing motion practice to amend a pleading or to add a party is 10/30/2026; after this date, no further amendments or joinder will be permitted unless good cause is shown. A joint discovery status letter is due to the Court on or before 12/18/2026. The parties must note that all discovery depositions must be completed at least 30 days before the close of fact discovery. The parties are encouraged to investigate jurisdictional issues as to potential witnesses in this matter. Fact discovery closes 1/29/2027.
If the parties engage in expert discovery, initial expert disclosures must be served by 1/29/2027, initial expert reports by 2/26/2027, and rebuttal expert reports by 4/23/2027. Expert discovery closes on 5/21/2026. By the same date, the parties must file a joint letter certifying the close of all discovery. Dispositive motion practice must commence on or before 6/18/2026, or the proposed JPTO must be filed on or before 5/21/2026, in accordance with the Individual Rules of the District Judge assigned to the case.
The parties are encouraged to pursue mediation through the Court-annexed mediation program. The parties may request such a referral to the program at any time by filing a joint request on ECF.
A District Judge has been assigned at the parties' request. The parties have not yet completed and filed the Acknowledgement Regarding the Right to Consent to Magistrate Jurisdiction (attached). The parties must do so expeditiously and must carefully review the Individual Rules of the District Judge.
