Order on Motion to Stay
PAPERLESS ORDER SETTING DEADLINE TO FILE CLOSING DOCUMENTS AND DENYING 14 MOTION TO STAY. Plaintiff has notified the Court that they have settled the case. The Court congratulates the Parties on reaching an amicable resolution of this matter. The Notice of Settlement also requests a 60-day deadline to file closing documents and a stay in the interim. Because this case was amicably resolved at an early stage, I will grant the Parties some latitude, but I will not stay the litigation for 60 days. Instead, I will give the Parties until July 29, 2026, to file appropriate closing documents. After that time the case will be set for trial and put on a litigation schedule. Until closing documents are filed, the Court expects compliance with all pretrial deadlines. However, I note that Defendant's Answer is due on July 20, 2026. In view of the pending settlement, and so as to avoid unnecessary litigation costs, I will extend that deadline only to July 29, 2026. Should the Parties be unable to finalize the settlement as planned, that shall not constitute good cause to further extend this filing deadline. Finally, the Parties are advised that I will reserve jurisdiction to enforce the Parties' agreement if requested to do so by motion prior to the filing of a self-executing stipulation of dismissal, or if the dismissal is made conditional upon my retaining jurisdiction. Signed by Judge Donald M. Middlebrooks on 7/8/2026. (kid)
