(IN CHAMBERS) ORDER RE STATUS REPORT RE PRIVATE NEUTRAL by Judge John A. Kronstadt: Based on a review of the September 10, 2026, Joint Report Regarding Private Neutral ("Report" (Dkt. 245 )), it presently appears that Plaintiffs' suggestion of having a co-mediator participate with Judge Pregerson would be productive. In light of the statement by Defendants' counsel that they would like the opportunity to confer with Plaintiffs' counsel as to a potential co-mediator who would participate with Judge Pregerson, counsel shall do so. Thereafter, on or before October 14, 2026, the parties shall file a joint report stating their collective and/or respective position(s) as to the participation of a co-mediator and suggestions as to who should be designated for that position if that approach is adopted. A status conference on this issue is set for October 26, 2026, at 10:30 a.m., with the precise time to be set when the final calendar for that date is issued. Counsel and parties may appear via Zoom, provided that they inform the Courtroom Deputy at JAK_Chambers@cacd.uscourts.gov by Noon on October 22, 2026, of their intent to do so.
