Order ~Util - Terminate Motions
TEXT ORDER: This matter comes before the Court upon review of the docket. On November 28, 2023, Plaintiffs moved to dismiss (ECF No. 61 ) Defendants' Counterclaims (ECF No. 56 ) in this matter. On December 19, 2023, however, Defendants filed an Amended Answer and Amended Counterclaims. (ECF No. 62 .) Shortly thereafter, Plaintiffs moved to dismiss Defendants' Amended Counterclaims. (ECF No. 64 .) Defendants opposed this second motion (ECF No. 65 ), and Plaintiffs replied (ECF No. 66 ). As the parties have only briefed Plaintiffs' second-filed motion (ECF No. 64 ), Plaintiffs' original motion to dismiss (ECF No. 61 ) is moot, and the Clerk's Office is instructed to terminate that motion. So Ordered by Judge Michael A. Shipp on 4/17/2024. (jdb)
