MINUTE ORDER. The City of Centralia's motion to dismiss (Dkt. 25 ) is GRANTED. Plaintiff's complaint does not provide any factual allegations to support his claims against the City of Centralia. He does not provide facts to show the City's role in any of his alleged violations of the law, nor does he provide any facts that would show a violation by the City of the Fourth or Fourteenth Amendments, or that the City is engaged in a civil conspiracy. Mr. Houghtaling's allegations and evidence about the role of the City in agreeing to provide sewer service do not support his legal claims. Because nothing in Mr. Houghtaling's allegations, evidence, or response to the motion to dismiss show that he could conceivably allege facts against the City to support his claims, the Court finds that amendment would be futile. The claims against the City of Centralia are therefore DISMISSED WITH PREJUDICE and the Clerk shall terminate the City of Centralia as a Defendant. Authorized by District Judge Tiffany M.
