Scheduling Order
SCHEDULING ORDER: This FLSA matter settled in principle in March prior to Plaintiffs' attorney's unexpected passing. Parties have been unable to finalize the settlement paperwork or file a Cheeks motion for settlement approval considering this unfortunate development. The Court will hold a settlement conference for 9/30/2026 @ 3:00 PM to discuss any remaining issues as to settlement. To facilitate that discussion, the Court respectfully refers this matter to the Eastern District of New York Mediation Advocacy Program for the appointment of pro bono counsel for the limited purpose of preparing for and representing the Plaintiffs at this settlement conference.
If the Plaintiffs secure private counsel prior to this conference, they should promptly inform the court and contact Defendant.
Defendant's counsel is directed to serve this order on the named Plaintiffs and the opt-in Plaintiffs at their last known addresses, along with the two putative class members who attended the 7/31/2026 status conference. Defendant's counsel need not serve this order on the remaining putative class. So Ordered by Magistrate Judge Seth D. Eichenholtz on 8/3/2026. (DC)

MINUTE ENTRY for a Telephone Conference held before MJ Eichenholtz on 7/31/2026. Appearance for Plaintiff: NONE. Appearance for Defendant: John J. Porta. Status conference held. There were no appearances by counsel for Plaintiffs or any of the Plaintiffs. Mohammed Salim Ahmed and Emad Wahba, who are members of the putative class, appeared on the call. Given the circumstances, the case is stayed pending further order of the Court. The Court will shortly file an Order regarding the next conference in this case.
