Order on Motion to Compel
ORDER denying 121 Letter Motion to Compel; denying 122 Letter Motion to Compel. The second set of requests for production exceeds the scope of the phase one discovery permitted by the Court. Such phase one discovery was the result of a meet-and-confer process arising from the first ten RFPs. No agreement had been reached to permit additional rounds of discovery, nor has the Court authorized such additional discovery. To the contrary, the Court declined to enter into a Case Management Plan until after the motion to dismiss had been resolved. Should either party seek leave to engage in additional discovery beyond phase one, that party should submit a letter seeking a conference to discuss what the need for such additional discovery would be, and the proposed parameters of such discovery.
