ORDER: The Court is in receipt of the parties' separate submissions proposing discovery schedules 170 , 171 , submitted in direct contravention of the Court's April 18, 2024 directive that the parties were to submit a joint status report. Given the parties' failure to coordinate, and in light of the age of the case and the discussion held on the record at the status conference on February 13, 2024, the Court orders the following discovery schedule. Fact discovery, including fact depositions and class-wide discovery on the deduction claim, shall be completed on or before 9/30/2024. The parties are directed to file a joint status report certifying the close of fact discovery by 10/7/2024. Exchange of expert disclosures shall be completed by 10/15/2024. Exchange of rebuttal expert reports shall be completed by 11/1/2024. Expert depositions shall be completed by 11/12/2024. All expert discovery shall be completed by 12/2/2024, and certification of the completion of all discovery shall be filed on ECF by 12/9/2024.
Plaintiff's proposal to schedule motions to compel is denied. The parties are respectfully directed to familiarize themselves with the undersigned's individual rules, which require parties to meet and confer and to prepare joint filings in the event of discovery disputes. Defendants indicate that they anticipate initiating a motion for summary judgment on Plaintiff's NYLL overtime pay claim. Both parties anticipate that Plaintiffs will initiate a motion for class certification. The parties are reminded that any such motion practice must be initiated in accordance with the individual rules of the assigned District Judge. The last date to take the first step as to any such motion practice shall be 12/30/2024.
All counsel are respectfully reminded that they are expected to comply with Fed. R. Civ. P 37(a), Local Rule 26.4, and the Court's individual rules in conducting discovery. Local Rule 26.4 expressly requires counsel to cooperate with one another in all phases of the discovery process, and to be courteous with one another. My individual rules require parties to make a good faith effort to resolve disputes before making a discovery motion. To properly confer to resolve a pending motion, the opposing party must be made aware that a motion to compel is being contemplated, and the parties must actually speak and communicate about the motion before it is filed to satisfy their obligations. An email exchange is not sufficient to establish a meet and confer. In addition, as noted above, the Court's individual rules require parties to meet and confer and file a joint letter summarizing the nature of any discovery dispute when requesting an informal discovery conference.
