MINUTE ENTRY for Status Conference/Motion Hearing held on 9/1/2026 before Magistrate Judge Timothy P O'Hara. ORDERED: Plaintiff's Motion for Extension of Time or Continuance [ECF 139 ] is DENIED as moot.Plaintiff's Motion for Court Order Directing Defendants to Deposit Funds in This Court's Registry Pursuant to F.R.C.P 67 and Declaration of Successor Liability [ECF 161 ] is DENIED.Plaintiff's second Motion for Court Order Directing Defendants to Show Cause for Failure to Comply with F.R.C.P. 7.1 and for Sanctions [ECF 164 ] is DENIED as moot as duplicative of ECF 163 . Plaintiff's first Motion for Court Order Directing Defendants to Show Cause for Failure to Comply with F.R.C.P. 7.1 and for Sanctions [ECF 163 ] is DENIED without prejudice as premature, as discussed on the record. Plaintiff's Motion for Leave to Exceed Five (5) Page Limit for Plaintiff's Motion to Join Vireo Growth, Inc., Vireo Health of Rocky Mountain, LLC, and Vireo of Foothills, LLC as Successor in Liability Defendants, Pursuant to F.R.C.P. Rule 25(c) [ECF 173 ] is GRANTED. Accordingly, Plaintiff shall be permitted to file a Motion to Join that does not exceed ten (10) pages. The Court notes that this page limitation extension applies only to the forthcoming Motion to Join referenced in Plaintiff's Motion [ECF 173 ] and the page limitation continues to apply as to all other Motions.For good cause shown, the Motion to Withdraw as Counsel of Record [ECF 170 ] filed by Nicholas Hankins and Laurie Rust on behalf of Defendants is GRANTED. Accordingly, Nicholas Hankins and Laurie Rust's representation of Defendants in this case is hereby terminated. Should the Parties not reach a settlement as to all claims, the Court will permit Defendants an extension of time to depose Plaintiff.
