ORDER Denying 71 Motion to Dismiss. ORDER Denying 77 Motion to Dismiss. ORDER Denying 80 Motion to Dismiss.
ORDER Granting in part and Denying in part 79 Motion to Dismiss. The motion is denied as to Plaintiff's beneficiary liability claim and granted as to Plaintiff's perpetrator liability claim.
It is further ordered that Plaintiff's request for leave to amend her perpetrator liability claim against Circus Eldorado is granted. It is further ordered that, if Plaintiff chooses to file a first amended complaint curing the deficiencies of the Complaint, as outlined in this Order, Plaintiff must file the amended complaint within 30 days from the date of entry of this order. If Plaintiff chooses not to file an amended complaint by that date, only her beneficiary liability claim will proceed against Circus Eldorado.

MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi: ORDER DISMISSING ACTION PURSUANT TO FEDERAL RULE OF CIVIL PROCEDURE 41(B). The Court granted Defendant Meruelo Group LLC's motion to dismiss the complaint of Plaintiff Get After It Media, Inc., and ordered Plaintiff to amend its complaint by its deadline to do so under Federal Rule of Civil Procedure 15(a)(l)(B), August 5, 2026. (Order, ECF No. 17.) The Court warned that "[f]ailure to comply will result in dismissal for failure to prosecute." (Id.) To date, Plaintiff has not filed an amended complaint. Having considered these factors, dismissal for failure to prosecute and to comply with the Courts order directing the filing of an amended complaint is appropriate. The case is dismissed without prejudice. This Order shall constitute notice of entry of judgment pursuant to Federal Rule of Civil Procedure 58. Pursuant to Local Rule 58-6, the Court orders the Clerk to treat this order, and its entry on the docket, as an entry of judgment. (Made JS-6. Case Terminated.) (lc)
