MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 7/14/2026.
The Court has before it Plaintiff's Motion to Seal Exhibits 4, 5, 7, 11, 12, & 14 in Support of His Response to Defendants' Motion to Strike (ECF No. 249 ). Plaintiff offers two bases in support of sealing: (1) the parties agree the documents are properly sealed; and (2) the documents were produced with a "confidential" designation under the Stipulated Protective Order. Well settled law establishes Plaintiff's proffer is insufficient to meet the Ninth Circuit standard for sealing. Heath v. Tristar Prod., Inc., Case No. 2:17-cv-02869-GMN-PAL, 2019 WL 12311995, at *2 (D. Nev. Apr. 17, 2019) ("The mere existence of a stipulated protective order and... designation of a document as confidential, alone, are insufficient grounds to seal a document."). Instead, Plaintiff must establish good cause or compelling reason for sealing as required under Kamakana v. City & Cty. of Honolulu, 447 F.3d 1172 (9th Cir. 2006).
Accordingly, IT IS HEREBY ORDERED that Plaintiff's Motion to Seal Exhibits 4, 5, 7, 11, 12 & 14 in Support of His Response to Defendants' Motion to Strike (ECF No. 249 ) is DENIED without prejudice.
IT IS FURTHER ORDERED that Exhibits 4, 5, 7, 11, 12, & 14 will remain provisionally sealed pending a ruling on a renewed motion to seal that establishes good cause or compelling reason for sealing.
